These Terms of Service ("Terms") govern your access to and use of the AI Headshot Generator service operated by Taz ("Taz," "we," "us," or "our"). By using the service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the service. By using AI Headshot Generator, you confirm that you can form a binding agreement and that the information you provide is accurate.

2. The Service

AI Headshot Generator lets users upload photos and generate AI-created headshots for personal or professional use. Features, pricing, output counts, and delivery methods may change over time.

3. Accounts and Access

Some features may require you to provide an email address, complete checkout, or otherwise create a session with us. You are responsible for any activity that occurs through your account or checkout session and for keeping your device and credentials secure.

4. Acceptable Use

You agree not to use the service to:

• impersonate another person in a misleading or deceptive way;
• create deepfakes, non-consensual intimate imagery, defamatory content, or other harmful synthetic media;
• upload photos you do not have the right to use;
• violate any law, regulation, or third-party right;
• interfere with the service, reverse engineer it, or attempt unauthorized access; or
• use the service to build a competing product or automated abuse workflow.

We may suspend or terminate access if we reasonably believe your use violates these Terms or creates risk for us, other users, or third parties.

5. User Content

You retain ownership of the photos you upload. You grant us a limited license to host, process, transmit, and use your uploaded content solely to operate the service and deliver your requested headshots.

You represent that you have all necessary rights and permissions to upload the photos you submit.

6. Generated Output and Intellectual Property

As between you and Taz, you own the final headshot images generated for you, subject to:

• your compliance with these Terms;
• any rights embedded in the materials you uploaded; and
• any rights or restrictions imposed by applicable law or third-party providers.

We retain ownership of the service itself, including the website, software, branding, workflows, and all related intellectual property.

7. Payments, Refunds, and Cancellations

AI Headshot Generator currently charges one-time fees through Paddle. By completing a purchase, you authorize Paddle to collect the applicable amount, taxes, and any required billing information.

Unless required by law, purchases are non-refundable once headshots have been generated or delivered. If a technical failure prevents delivery of the purchased service, contact support and we may, at our discretion, provide a replacement run or refund.

8. Third-Party Services

The service relies on third-party providers, including Replicate, Paddle, and Vercel. We are not responsible for outages, delays, policy changes, or failures caused by those providers.

9. Availability and Changes

We may update, modify, suspend, or discontinue any part of the service at any time. We do not guarantee uninterrupted availability or that generated outputs will meet every expectation or use case.

10. Disclaimers

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

AI-generated outputs may contain errors, artifacts, or unexpected results. You are responsible for reviewing outputs before using them publicly or commercially.

11. Limitation of Liability

To the maximum extent permitted by law, Taz will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the service.

Our total liability for any claim related to the service will not exceed the amount you paid us for the specific order giving rise to the claim.

12. Indemnity

You agree to indemnify and hold harmless Taz from claims, damages, losses, and expenses arising out of your uploaded content, your use of the service, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the service at any time if we reasonably believe you violated these Terms or created legal, security, or operational risk.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Taz is established, without regard to conflict-of-law rules.

15. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the updated version and revise the "Last updated" date. Your continued use of the service after the updated Terms take effect means you accept them.
